Terms of sale

1. Seller

2. What we sell

Vivory is a digital service. Creating an event, inviting your loved ones and collecting memories is free. Paid options, charged once per event — no subscription, no renewal — unlock further features.

Prices are in euros, including all taxes. For a customer residing in another European Union country, the applicable VAT is that of their country of residence, already included in the displayed price. The applicable price is the one shown on screen at the time of payment. When upgrading, only the difference between the amount already paid and the price of the new plan is charged.

3. Launch offer

From 1 to 30 September 2026 inclusive (Paris time), the Essential and Premium plans are offered at half price — €7.49 and €14.99 instead of €14.99 and €29.99. The offer applies automatically to purchases made during that period, with no code to enter; it cannot be combined with any other discount and does not apply retroactively to earlier purchases. The reduced price is the one displayed before payment is confirmed. After 30 September 2026, standard prices apply. For any later upgrade, the difference is calculated on the amount actually paid.

4. Order and payment

A purchase relates to an event you have created. The sales channel depends on where the purchase is made, and determines who collects the payment:

The order is final once payment is confirmed. A receipt is issued by whoever collected the payment (Stripe, Apple or Google), and the purchase history remains available in the app.

5. Delivery

Purchased features are unlocked immediately after payment is confirmed, on the event concerned. Should a technical issue prevent this, write to us: we will restore access or refund you.

6. Right of withdrawal

Under Article L221-18 of the French Consumer Code, you normally have 14 days to withdraw from a distance purchase, without giving a reason.

Exception that applies here. Our options are digital content supplied immediately. By confirming payment, you expressly request immediate access and acknowledge losing your right of withdrawal once the feature is unlocked (Article L221-28, 13° of the French Consumer Code). This is repeated on the payment screen before you confirm. Until payment is confirmed, no amount is charged and the purchase can be abandoned at any time.

For a purchase made on the App Store or Google Play, Apple's or Google's own withdrawal and refund terms apply, and the request must be sent to them directly.

7. Refunds

Outside the case above, a refund is granted where the purchased service could not be delivered: unlocking impossible, a persistent technical fault on our side, or a double payment. Write to contact@vivory.fr from your account address: we reply within 7 days and, where agreed, the refund is made to the original payment method within 14 days. For purchases made through the App Store or Google Play, the request is handled by Apple or Google; we will help you put it together if needed.

8. Wish list and contributions

The wish list (also called the “group gift” in the app) is a shared register, not a payment service. Vivory collects no contribution, holds no funds and plays no part in any transfer of money: each guest states what they intend to give, and payment is settled directly between the guest and the organiser, by whatever means they choose. The amounts recorded are neither a purchase from Vivory nor a debt owed by Vivory, and cannot give rise to any claim or refund from us.

9. How long content is kept

An event's content (memories, album, film) stays available online for 90 days after the event is closed, whichever plan was purchased, then is deleted automatically. You are warned by email before the deadline, more than once. We recommend downloading the film and album as soon as you close the event — the downloaded file is yours, with no time limit.

10. Warranties and liability

The service benefits from the legal guarantee of conformity (Articles L217-1 et seq. of the French Consumer Code). We do everything we can to keep the service available and content safe, without being able to guarantee uninterrupted availability. Our liability shall not exceed the amount actually paid for the event concerned.

11. Complaints and mediation

For any complaint, please write first to contact@vivory.fr. Failing a satisfactory solution within 30 days, you may refer the matter free of charge to our consumer mediator: CMAP — the Paris Mediation and Arbitration Centre, 39 avenue Franklin D. Roosevelt, 75008 Paris — cmap.fr/la-mediation-de-la-consommation. Referral is free for consumers and is only possible after a written complaint has been made to us.

12. Governing law

These terms are governed by French law. They do not affect the rights that the law of your country of residence guarantees you as a consumer.
